SRINAGAR: The High Court of Jammu and Kashmir directed the District Magistrate of Anantnag to take over the possession of migrant property currently occupied by an ‘Ashram’ and return it to the migrant owners according to the Migrant Act.

The petitioners stated that their grandfather and father owned land measuring 05 Kanals, 01 Kanal and 02 Marlas, 01 Kanal and 17 Marlas, 01 Kanal and 17 Marlas, 03 Kanals and 06 Marlas, and 05 Marlas in village Trahpoo, tehsil Achabal, district Anantnag.

They claimed they approached revenue authorities to transfer the land into their names but were informed that some individuals representing an Ashram/Committee had also shown interest in the land.

As the legal heirs, they sought protection of their property from the DC Anantnag under the Jammu and Kashmir Migrant Immovable Property (Preservation, Protection and Restraint on Distress Sales) Act, 1997, but no action was taken.

Justice M A Chowdhary reviewed the arguments and records, allowed the petition, and instructed the District Magistrate, Anantnag, to take possession of the land and return it to the petitioners in accordance with the 1997 Act. -(KL)
